David Emanuel, Sr. (ca 1710 - 1768)

David Emanuel, Sr. was born before May 1710, likely in Chester County, Pennsylvania. He was a son of Emanuel Jones and his wife Jane. The mother of David Emanuel has not been identified.

On 4 May 1731, David Emanuel witnessed the will of John Lewis in Charlestown Township of Chester County, Pennsylvania (318). Emanuel Jones, John Rees, and Morgan Williams also witnessed this will.

On 30 Mar 1734, David Emanuel was issued a warrant to survey 150 acres of land in Charles Town Township of Chester County, Pennsylvania (120). On 10 Feb 1735, Jonathan Taylor surveyed a tract of 136 acres for David Emanuel (325), and a patent was recorded on 15 Jan 1736 (326). On 26 Feb 1736, Thomas Penn issued a patent to David Emanuel for 136 acres of land in Charles Town Township of Chester County, Pennsylvania, adjacent to land held by John Budd deceased and by Matthias Martin (326). David Emanuel acquired this land for £41.1s.7d Pennsylvania money.

Before about 1735, David Emanuel married. His wife has not been identified; however, her given name may have been Martha. In about 1736, a son, John Emanuel, was born to David Emanuel and his wife. At the birth of his son, David Emanuel was about 26 years of age.

On 3 Nov 1736, David Emanuel, Sr. witnessed the Will of David Giby in Charles Town Township of Chester County, Pennsylvania (327).

On 1 Nov 1744, an item in Franklin’s Penn Gazette advertised a tract of 218 acres in Charles Town Township of Chester County, Pennsylvania; enquire of Emanuel Jones and David Emanuel living on the same (250).

Before 1748, the David Emanuel, Sr. family migrated from Chester County, Pennsylvania to Lunenburg County, Virginia (105, Page 302). He was included in a 1748 tax list for Lunenburg County (14, Page 78), and on 4 Nov 1748, he witnessed the Will of John Mills made in Lunenburg County. David Emanuel appeared on the 1749 Lunenburg County, Virginia tax list, and a daughter Martha Emanuel, was born there in 1749.

A 1 Jan 1750 deed for the sale of land by William Rees to John Ruffin mentions land owned by David Emanuel on the west side of Ward's Fork in Lunenburg County, Virginia (177). This deed described land adjacent to that owned by Even Thomas and David Emanuel. Ward's Fork is located in present-day Charlotte County, Virginia.

On 31 Mar 1753, David Emanuel, Sr. was granted 530 acres of land on the west side of the North Fork of Fishing Creek in North Carolina. On 11 Jan 1754, David Emanuel conveyed this land to John Walker.

The David Emanuel, Sr. family migrated to St. George Parish, Georgia before about Apr 1755. On 14 Apr 1757, the Governor of Georgia granted David Emanuel 200 acres of land on the south side of Brier Creek, adjoining land of James Hutson (634). With his petition for this land grant, David Emanuel stated that he “set down on lands on the south side of Brier Creek nigh two years and had cultivated several acres but had had no opportunity hitherto of petitioning for the same.”

Before 27 Mar 1759, the David Emanuel family migrated from Lunenburg County to St. George Parish, Georgia where David Emanuel was appointed tithes and fines collector. During the period Apr - Nov 1760, David Emanuel, Sr. served as a Justice of the Peace in St. George Parish, where he was a successful planter. 

On 22 Nov 1768, David Emanuel, Sr. made a Will in St. George’s Parish of Georgia naming sons Amos Emanuel, David Emanuel, Levi Emanuel, and Asa Emanuel; and daughters Elizabeth Emanuel, Rebeckah Emanuel, Martha Emanuel, and Ruth Emanuel (317). David Lewis, Thomas Lewis, and Thomas Lewis, Jr. witnessed this Will.

David Emanuel, Sr. died in St. George Parish before the probate of his estate on 6 Mar 1769. An inventory of his estate was filed on 5 Aug 1769 in St. George Parish (638).

At his death, David Emanuel, Sr. owned 200 acres of land on Chevis's Creek in St. George Parish, Georgia (105).

Notes and Comments

If David Emanuel was at least 21 years old when he witnessed the will of John Lewis in Chester County, Pennsylvania, then he was born before May 1710.

On 4 May 1731, David Emanuel witnessed the Will of John Lewis in Chester County, Pennsylvania. Assuming that David Emanuel was at least 21 years of age at that time, then he was born before 1710.

The Will of Emanuel Jones names his son David Emanuel, and this will is the primary evidence of their relationship.

Emanuel Jones also witnessed the Will of John Lewis.

A 1 Jan 1750 deed for sale of land by William Rees to John Ruffin mentions land owned by David Emanuel on the "west side of Wards Fork."Wards Fork Creek lies in present-day Charlotte County, Virginia. Charlotte County and Mecklenburg County were created from parts of Lunenburg County on 1 Mar 1765.

Additionally, David Emanuel appears on lists of tithables for 1748,1749, and 1750 assembled by William Caldwell. Mr. Caldwell's area of responsibility is described as "from Falling River to Little Roanoke River" and "from Little Roanoke up the Fork." Generally, Mr. Caldwell was responsible for the eastern part of present-day Campbell County.

In the Name of God. Amen. This Twenty Second day of Nov. One Thousand seven hundred Sixty eight. I David Emanuel of the Parish of St. George in the Province of Georgia planter gentleman being very sick & Weak of Body but of perfect mind & memory, calling to mind the mortality of my body and that it is ordained for all Men once to Dye do make this my last Will & testament in manner and form following: That is to say as for my Soul I commend it into the hands of God my Savior and redeemer by whose merits alone I hope to be Saved and to have full redemption of all my Sins as for my Body I commend it to the Earth to be buried in a Christian Like and decent manner at the discretion of my Executors, nothing doubting but at the general Resurrection I shall receive the same by the mighty powers of God; as touching such worldly Estate wherewith it hath pleased God to bless me with in this Life I give devise and bequeath in manner following

Viz. Imprimis it is my will that all my Just debts and funeral expenses be paid and discharged by my Executor hereafter named.

Item I give and bequeath unto my beloved Sons Amos Emanuel David Emanuel Levi Emanuel and Asa Emanuel the Sum of five Shillings Str to be paid to each of them within six months after my decease by my Executor if demanded.

Item I give and bequeath unto my beloved Daughters Elizabeth Rebeckah Martha & Ruth the like sum of five shillings Str to be paid to each of them as above.

Item I give and bequeath to my Son Amos Emanuel three cows & calves and two sows and pigs to be delivered to him within six months after my decease by My Executor.

Item I give and bequeath to my Son David Emanuel three cows & calves and two sows and Pigs to be delivered to him within six months after my decease by My Executor.

Item I give and bequeath to my Son Asa Emanuel 1/20 share of Twenty pounds Str in Cattle and horses to be delivered as above.

Item I give and bequeath to my Son Levy Emanuel his heirs and Assigns all that tract of Land containing two hundred acres whereon I now Live together with the Buildings and Improvements thereon

Item I Give and bequeath to my Daughter Ruth Emanuel three Cows & calves to be delivered her within six months after my decease by My Executor.

Item I Give and bequeath to my Sons Amos, David, Levi, and Asa and Daughters Martha and Ruth all my Books to be equally divided between each of them.

Item it is my Will that a Certain tract of Land containing two hundred acres in the Parish aforesaid situated and being in a Creek Commonly called Cheviss Creek be sold by My Executor in order to defray my Just debts.

Item I Give and bequeath the residue and remainder of my Estate after my Just debts, funeral expenses together with the Legacies before mentioned are paid unto my Son Levi Emanuel whom I do constitute and appoint my Sole Executor of this my last will & Testament & I do hereby revoke disanull all other former Wills ratifying & confirming this and no other to be my Last Will & Testament. In witness whereof I have hereunto set my hand & Seal this day and Year first above written.

Georgia Before his Excelly James Wright Esqr Captain General & Governor in Chief of his Majesty's Said Province and Ordinary of the Same Personally appeared Thomas Lewis of the Parish of St George Planter one of the subscribing Witnesses to this will written last Will and Testament of David Emanuel of the same Parish Planter deceased who being duly Sworn on the hold Evangelists of Almighty God made oath that he was present and did see the said Testor sign Seal publish pronounce & declare the same to be & contain his last will & Testament and that was of Sound & disposing mind and memory to the best of his knowledge and belief and that he with David Lewis and Thomas Lewis the Younger subscribed their names to the said will at the request and in the presence of the said Testor and in each other's presence.

At the Same time Levi Emanuel the Executor named in the said Will Qualified as Such. Given under my hand this 6th March 1769

Notes and Comments

On 3 Nov 1736, David Emanuel, Sr. witnessed the will of David Giby in Chester County, Pennsylvania. The will provides for David Jones, Mary Jones, and Thomas Jones all children of Margret Lewis, a niece of David Giby, by her first marriage. There may be a relationship between the children of Margaret Lewis and Emanuel Jones, the father of David Emanuel, Sr.

An entry in the David Hollingsworth Database states that in Apr 1757 David Emanuel petitioned for 200 acres on the south side of Brier Creek adjoining James Hutson, and that he "had set down on said land nigh two years." This information implies that David Emanuel, Jr. migrated from Lunenburg County, Virginia to Georgia before 1756.
